Red Rabbit Wage Lawsuit

On Tuesday, June 7, 2016, Fitapelli & Schaffer, LLP filed a class action wage lawsuit against Red Rabbit, a business that focuses on the preparation of healthy school meals for over 150 schools in the New York City area. Despite the company’s positive initiative to offer healthier food options to NYC school kids, it seems as though they are doing it at the expense of its hard working employees. This wage lawsuit, which represents cooks, food buyers, porters and other “Non-Exempt Workers” working for Red Rabbit, asserts that Red Rabbit’s employees were wrongfully denied their lawfully earned wages under the Fair Labor Standards Act (FLSA) and New York Labor Law (NYLL).

In that regard, affected workers were consistently working well over 40 hours per work week without receiving the proper overtime pay at time and a half their regular hourly rate. The wage lawsuit also alleges that Red Rabbit failed to pay its affected workers spread of hours pay when they worked shifts over 10 hours per day. Also, Red Rabbit failed to keep track of all of the hours its affected employees were working and consequently failed to provide accurate wage statements. As such, affected employees were not compensated for all of their hours worked. It is believed that Red Rabbit applied the same compensation and employment policies, practices, and procedures to all Non-Exempt Workers companywide. This wage lawsuit seeks to recover overtime compensation, spread of hours pay, and statutory penalties for the named Plaintiff and all Non-Exempt Workers.
